Federal District Court confirms validity of IAPSC Best Practice regarding Forensic Methodology

The plaintiff sought to exclude Witherspoon arguing that he failed to comply with the standard for expert testimony under the Federal Rules of Evidence. Witherspoon presented evidence, through defense counsel, that he had complied with the Best Practice for Forensic Methodology as adopted by the IAPSC in June 2000.

In a very detailed opinion, the court ruled that Witherspoon had evaluated the case in accordance with professional practice as articulated by the Best Practice #2 Forensic Methodology.
